These terms are the agreement between you and TheFootWear covering your use of thefootwear.shop and anything you buy from it. Browsing the site or placing an order means you accept them. If any part is unacceptable to you, please don’t use the site.

Who may order. You need to be 18 or older, or of legal age where you live, and able to enter into a binding contract.

Listings and prices. We describe our footwear as accurately as we can, but we don’t promise that every description, photograph, measurement or price on the site is free of error. Colours also vary between screens, so a leather may read warmer or cooler than it appears. Prices are in US dollars and can change at any time. Where an item has been listed at an obviously wrong price or with materially wrong details, we may cancel the order even after it has been confirmed, and we will refund you in full.

How an order works. Your checkout submission is an offer to buy. We may accept it, decline it, or limit quantities — for example where we suspect card fraud or where a size has just sold out. The automatic confirmation email is a receipt of your offer, not our acceptance; the contract comes into being when we dispatch the pair. Money taken for an order we then cancel is returned in full.

Paying. Payment is collected at checkout through the providers listed there. By completing the purchase you confirm the payment method is yours or that you are authorised to use it.

Our content. The text, photographs, layout, logo and name on this site belong to us or are licensed to us. Personal use is fine; copying them for commercial purposes is not, without our written permission.

Using the site properly. Don’t attempt to break into any part of the site, disrupt it for other people, scrape it wholesale, or submit information you know to be false.

Warranties and disclaimers. Our footwear carries the craftsmanship cover set out in the Refund & Returns Policy. Beyond that cover and any rights you hold under consumer law that cannot be excluded, the site and the goods are supplied as they are, without further warranties.

Limits on what we owe. To the fullest extent the law permits, TheFootWear is not liable for indirect, incidental or consequential losses, and our total liability on any claim will not exceed what you paid for the item the claim concerns.

Which law applies. California law governs these terms, and any dispute will be heard by the state or federal courts sitting in Los Angeles County, California.

Changes. We may revise these terms; continuing to use the site after the revision is posted means you accept it.
